Welcome to the SpringsKeystone (the “Site”), an independently operated website providing information about 53 Hunki Dori in Keystone, Colorado, including building amenities and a directory of individually owned units available for short-term rental. Please read these Terms of Service (“Terms”) carefully before using the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Independent Operation — Not an Official HOA Platform

This Site is independently owned and operated and is not an official website, service, or publication of the The Springs Homeowners Association (the “HOA”) or any of its board members, officers, or management company. The Site is not authorized, sponsored, endorsed, or controlled by the HOA unless expressly stated otherwise. Any views, descriptions, or representations on the Site are those of the Site operator and individual unit owners, not the HOA.

2. Description of Service

The Site provides:

  • General information and photographs about the The Springs building and its common-area amenities;
  • A directory of individual units that unit owners may voluntarily list for informational purposes; and
  • Links to third-party booking platforms (such as Airbnb and VRBO) where visitors may view and book individual units directly.

The Site is not a booking platform, payment processor, property manager, or rental agency. All bookings, payments, cancellations, and guest communications occur entirely on the applicable third-party platform (e.g., Airbnb or VRBO), subject to that platform’s own terms of service. We are not a party to any rental transaction or agreement between a guest and a unit owner.

3. No Representations or Warranties Regarding Listings

Each unit listed on the Site is independently owned and managed by its respective owner. The Site makes no representations, warranties, or guarantees of any kind — express or implied — regarding any listing, including but not limited to:

  • The accuracy, currency, or completeness of any unit description, photograph, pricing, or availability;
  • The condition, safety, cleanliness, or suitability of any unit;
  • Whether a listed unit holds a valid short-term rental license or is otherwise compliant with applicable Town of Keystone, Summit County, or State of Colorado laws and regulations;
  • The identity, conduct, reliability, or responsiveness of any unit owner or host; or
  • The outcome, safety, or satisfaction of any booking made through a linked third-party platform.

Each unit owner is solely responsible for the accuracy of their listing and for their own compliance with all applicable licensing, tax, insurance, and legal requirements. Visitors and prospective guests are strongly encouraged to independently verify listing details, licensing status, and reviews directly on the third-party platform before booking.

4. Third-Party Platforms and Links

The Site contains links to third-party websites and platforms (including Airbnb and VRBO) that are not owned or controlled by the Site. We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third-party platform. Your use of any third-party platform is governed entirely by that platform’s own terms and policies.

5. User Accounts (Unit Owners)

To submit or manage a unit listing, an owner must register for an account and provide accurate, current information, including proof of ownership reasonably satisfactory to the Site operator.

By registering, you agree to:

  • Provide truthful, accurate, and non-misleading information about yourself and your unit;
  • Maintain the confidentiality of your login credentials and be responsible for all activity under your account;
  • Update your listing promptly if information (including booking links, licensing status, or amenities) changes or becomes inaccurate;
  • Use the account only to list a unit you own or are otherwise authorized to list.

We reserve the right to review, edit, decline, suspend, or remove any listing or account at our sole discretion, including for inaccurate information, suspected lack of ownership, or non-compliance with these Terms.

6. User-Submitted Content

By submitting text, photographs, or other content to the Site (“User Content”), you represent and warrant that:

  • You own the content or otherwise have full rights and authority to submit and display it;
  • The content does not infringe any third party’s copyright, trademark, privacy, or other rights; and
  • The content is accurate and not misleading.

You grant the Site operator a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your User Content solely in connection with operating the Site. You may request removal of your content by removing your listing or contacting us directly.

We reserve the right to remove any User Content that we believe, in our sole discretion, violates these Terms, applicable law, or is otherwise inappropriate.

7. Short-Term Rental Compliance

Colorado and Summit County/Town of Keystone regulations may require unit owners to hold a valid short-term rental license and to display that license number on any advertisement of the unit, including listings on this Site. It is the sole responsibility of each unit owner — not the Site — to obtain and maintain any required licenses, to remit any applicable taxes, and to comply with all applicable short-term rental laws. The Site operator does not verify licensing status on an ongoing basis and disclaims any responsibility for an owner’s non-compliance.

8. Prohibited Uses

You agree not to:

  • Submit false, misleading, or fraudulent listing information;
  • Impersonate another unit owner or misrepresent your authority to list a unit;
  • Use the Site for any unlawful purpose or in violation of any applicable local, state, or federal law;
  • Attempt to scrape, harvest, or misuse other users’ contact or personal information;
  • Interfere with or disrupt the security or proper functioning of the Site;
  • Upload content containing viruses, malware, or other harmful code.

9. Intellectual Property

Except for User Content and third-party materials, all content on the Site — including text, graphics, logos, and design — is owned by or licensed to the Site operator and may not be copied, reproduced, or distributed without permission.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LISTING INFORMATION IS ACCURATE OR RELIABLE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY LISTING, OR ANY BOOKING OR TRANSACTION MADE THROUGH A THIRD-PARTY PLATFORM. IN NO EVENT SHALL THE SITE OPERATOR’S TOTAL LIABILITY EXCEED [e.g., ONE HUNDRED DOLLARS ($100)] OR THE AMOUNT YOU PAID, IF ANY, TO USE THE SITE.

Some jurisdictions do not allow certain liability limitations, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Site operator, its owner(s), and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: your use of the Site, your listing or User Content, your violation of these Terms, or your violation of any applicable law or third-party right.

14. Termination

We may suspend or terminate your account or access to the Site at any time, with or without notice, for any reason, including violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

16. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Summit County, Colorado.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
